Tesco went to the Court of Session in June 2010 to block the building of a new Asda store on the site of the former NCR manufacturing unit at Wester Gourdie after Dundee City Council granted planning permission. However, in September it was announced that Lord Brailsford has rejected Tesco's arguments, meaning Asda and local project partners Macdonald Estates are free to proceed with their plans. However, Tesco then took Dundee Council to the UK Supreme Court.
