In late December 2009 Tesco submitted a planning application to open a convenience store with 100 parking spaces on a business park. Sainsbury's submitted an application for a supermarket in March 2010.

Sainsbury’s withdraw legal action

Stating that the cost of pursuing a High Court judicial review which would not serve any practical purpose, whether they won it or not.

Sainsbury's submits legal action

Tesco opened it's store on the Marlborough business park on 21 February 2011 but Sainsbury's said its earlier application for a store should have been considered by planners. A Sainsbury's spokesman said it had submitted planning permission and then acquired a plot of land from Wiltshire Council. Sainsbury's said it felt it had no option but to take legal action because both planning applications had to be considered by the planning committee in order for a fair assessment to be made".

Despite a last minute appeal from Sainsbury’s to adjourn their decision until plans for its own rival store on the adjacent highways depot site could be considered.
