Campaigning to curb supermarket power

In May 2012 a campaign was launched to try to stop Tesco’s plans for an Express store. Boston Spa Say No to Tesco action group was formed in a bid to halt the Tesco's move on the Georgian listed Crown Hotel pub.  The group includes the local MP and more than a 1,400 people who have signed a petition against the supermarket.

Tesco also submitted their application for a Certificate of Lawful Use under application number 12/04329/CLE.  This is in support of their original contention that the Crown is only a public house ( Use Class A4 ) and is not a hotel which has a different Use Classification.

Tesco abandons plans

Tesco has pulled its plans to convert a Boston Spa pub into an Express store and does not intend to open a shop in the village. A Tesco spokesman confirmed that the company would not be proceeding with its plans to turn the Crown Hotel on Boston Spa’s High Street into a Tesco Express.

Tesco win appeal

The judgment of the enquiry was that although it was formally called a hotel, The Crown's primary business was as a public house, even though it did have a number of letting rooms.

Tesco appeals to Planning Inspectorate against the decision

A Public Inquiry started on 16th and 17th September in the Village Hall. The nub of the argument is all to do with the planning status of the former Crown Hotel.  Tesco wish to try and prove that it was just a pub or "drinking establishment"  with some occasional letting bedrooms available mainly on a bed and breakfast basis. In other words the accommodation side was only a relatively minor part of the pub business. In planning terms under legislation a "drinking establishment" is classed as A4 Retail use which would allow any lower A class Retail use to be created without any planning consent required for a change of use.

Plans refused

Leeds City Council Planning Department has refused the Certificate of Lawful Use applied for by Tesco to categorise The Crown Hotel, Leeds felt that there was enough evidence that the Pub was of mixed use and the bedrooms were not  ancillary to the use as a pub.
